A question that is raised more and more during consultations with my clients relates to the concept of “green” burials. When I speak with a client about their desires regarding the disposition of remains, there are usually only two options to discuss: cremation or burial. We discuss what planning needs to go into the implementation of either plan. However, recently, a third option has emerged. I believe that as we as a society recognize what actions may not be as environmentally conscious, some among us have endeavored to address a need there.

Recently, there has been significant media coverage of “green” burials. The idea behind a green burial is to serve the environment in the best possible way while offering a crematory or burial option to the deceased and his or her loved ones. The environmentally unfriendly aspects of traditional cremation or burial may include effects through the pH level of remains, toxic embalming chemicals, non-corrosive hardware on caskets, and deep grave depth not actually allowing the topsoil to reap any benefits from the decomposition process. Green burials can provide pH balancing of the cremated remains, as well as biodegradable burial products and a three-foot grave depth so that plant life on the surface may benefit.

Green burials may be relatively new as a concept, but they are fast becoming a legitimate and popular option. The state has kept up with this and has produced rules regulating the green burial process and industry. The facility or cemetery must be associated with a church and there are safeguards and supervision. A number of places in the Western North Carolina area now offer green burials and as estate planning attorneys, we are doing our own homework to see what we might be able to do to keep our clients informed and educated.
